DIFFERENCE BETWEEN SMALL AND MICRO ENTERPRISES 

Small enterprises are those where the manufacturing units made a minimum of Rs. 50 lakhs or say below. Micro Enterprises are those in which the manufacturing units have made a minimum investment of 

Rs. 20.5 lakhs or below. And when it comes to the service enterprises, they need to invest less than Rs. 10,00,000 in these kinds of enterprises. 

Specified Companies are those businesses that source their products from micro, small, and medium-sized businesses. Additionally, according to Section 9 of the MSMED (Micro, Small and Medium Enterprises Development) Act of 2006, companies whose payments to suppliers from Micro and Small Enterprises exceed 45 days from the date of acceptance or the date of deemed acceptance of the goods or services are in violation.

 


Annual Compliance For MSME

MSME Form 1 is way too mandatory annual compliance for the specified companies that are defined in Section 9 of the MSMED Act. The specified companies like Micro, Small, and Medium Enterprises Development file the MSME Form 1 on a half-year basis to the MCA. 

Is there a Return Periodicity of MSME Form 1?

Every specified organization is required to give the Registrar the following information every year on a half-yearly basis regarding the unpaid invoices to the Micro, Small, and Medium Enterprises, like: 

  • reasons for the delay 
  • the amount of payment due 

 

Responsibilities of the Specified Companies after MSME Registration 

The task does not stop here after Annual Compliance MSME Registration, there are more to the MSME that needs to be taken care of by the specified companies. 

 

  • the specified companies have to check whether their suppliers are registered or not 
  • If they are registered under the MSME Act, the Specified Companies must determine whether they owe any money for a period that has passed 45 days since the date they accepted the products or services. 

Additionally, the business must either close or submit a return of the details of the outstanding payments with an explanation in the MSME Form1.
